    Master Thesis
Uluslararası hukuk açısından Doğu Akdeniz'de yetki alanlarının sınırlandırılması
(2023) Kahraman, Atilla; Özer, Deniz Kızılsümer
East Mediterranean; It is a semi-enclosed sea with riparians such as Turkey, Syria, Lebanon, Israel, Egypt, Palestine, TRNC, Libya, Greece and Cyprus. The energy resources discovered in this region since the beginning of the 21st century have caused the countries of the region to want to earn income from these energy resources. Discussions on maritime jurisdiction areas between states in the Eastern Mediterranean region are handled within the framework of the 1982 United Nations Convention on the Law of the Sea (UNCLOS) and its related provisions. However, Tutkey is not a party to the 1958 Geneva Conventions and 1982 UNCLOS. For this reason, international judicial decisions and the rules of international customary law will guide the delimitation of maritime jurisdiction areas in the Eastern Mediterranean region for Turkey. Turkey rejects the unilateral activities of countries engaged in hydrocarbon exploration activities in the east and south of Cyprus. On the other hand, Greek Cypriot Administration and Greece claim that Turkey's activities in the Eastern Mediterranean are against international law. In order to make an equitable delimitation in the Eastern Mediterranean region, all other factors related to coastal lengths should be evaluated together. Since there is no obligatory and specific method for limitation, every method that includes 'equitable solution' is considered to be in accordance with equity. In this context, finding an equitable solution between the states in the region is extremely important for the peace and stability of the region. Reaching a consensus on the sovereignty rights of the parties will also enable the joint use of natural gas and oil resources in the region. This will contribute to the economic development of the states in the region.
