Kefalet sözleşmesinin geçerlilik koşulları

Abstract

Tezin konusu 'Kefalet Sözleşmesinin Geçerlilik Koşulları'dır. Tez üç bölümden oluşmaktadır. Birinci bölümde kefalet sözleşmesi hakkında genel bilgiler verilecektir. Bu kapsamda kefalet sözleşmesinin tanımı, yapısı ve taraflarına değinilecektir. İkinci bölümde kefalet sözleşmesinin geçerlilik koşullarına değinilecektir. Bölümün ilk kısmında sözleşmelerin genel geçerlilik koşullarına, ikinci kısmında ise kefalet sözleşmesine özgü geçerlilik koşullarına değinilecektir. Üçüncü bölümde ise, geçerlilik koşullarına uymamanın yaptırımı konusu incelenecektir. Bu bölümün ilk kısmında sözleşmelerin genel geçerlilik koşullarına uymamanın yaptırımı, ikinci kısımda ise kefalet sözleşmesine özgü geçerlilik koşullarına uymamanın yaptırımı konusu incelenecektir. Thesis subject is 'The Valıdıty Requırements Of The Suretyshıp Contract'. Thesis consists of three parts. In the first section, concept of suretyship contract analyzed along with its main features. Suretyship contracts are examined therein in terms of definition and features. Second section focus on the valıdıty requırements of the suretyshıp contract. Firstly, the conditions of validity of the contracts and then specific validity conditions of surety contract will be examined. Third section is focus on the failure to comply with the conditions of validity of contracts. The first part of this chapter focus on failure to comply with the terms of sanction of the general validity of the contracts. In the second part, the validity of the specific conditions of contract, failure to comply with bail enforcement will be examined.
