5271 Sayılı Ceza Muhakemesi Kanunu'nda adli kontrol

Abstract

Judicial control is a concept that doesn't have a long history. It has enshrined in our legal system with the Code of Criminal Procedure (n. 5271) dated 01.06.2005. The main purpose of judicial control, which is an independent protective measure, is to prevent the drastic effects of an arrest. In light of the principle of proportionality, judicial control has to be considered and applied before making an arrest. Lawmaker adopted a sentencing limit for the application of judicial control because of the concerns that it might be applied in crimes that has higher minimum and maximum sentencing limits. After judicial control was accepted in legal practice, the limit for judicial control is abolished with an amendment to the law and judicial control is allowed to be applied in all crimes. The number of requirements to comply with judicial control has also increased with the amendment. In this study, we initially explained the concept, purpose and characteristics of judicial control, examined the terms of application and requirements in detail, and analyzed termination, remedies and compensation of damages caused by unfair and unlawful use of judicial control. In conclusion section, we pointed out the problems of application in practice, along with the defects in legislation, and provided possible solutions. Adli kontrol, köklü geçmişi olan bir kurum değildir. 01.06.2005 tarihinde yürürlüğe giren 5271 sayılı Ceza Muhakemesi Kanunu ile hukuk sistemimize girmiştir. Adli kontrol bağımsız nitelikte bir koruma tedbiridir. Temel amacı tutuklamanın ağır sonuçlarını ortadan kaldırmaktır. Ölçülük ilkesi gereğince tutuklamadan önce adli kontrolün dikkate alınması ve uygulanması gereklidir. Özellikle cezasının alt ve üst sınırı fazla olan suçlarda uygulanabileceği endişesiyle kanun koyucu, adli kontrolün uygulanabilmesi için ceza sınırı benimsemiş idi. Adli kontrol uygulamada benimsenince, yapılan yasal değişikler ile ceza sınırı kaldırılmış ve tüm suçlar yönünden uygulanması olanağı getirilmiştir. Ayrıca adli kontrol yükümlülüklerinin sayısı da yapılan yasal değişiklikler ile artırılmıştır. Bu çalışmamızda öncelikle adli kontrol kavramı, adli kontrolün amacı ve özellikleri açıklanmış, uygulanma şartları ve yükümlülüklere ayrıntılı olarak yer verildikten sonra kanun yolu, sona ermesi, haksız uygulanması nedeniyle meydana gelen zararın nasıl tazmin edileceği irdelenmiştir. Sonuç kısmında ise uygulamada yaşanan sıkıntılara ve mevzuattaki eksikliklere dikkat çekilerek çözüm önerileri getirilmeye çalışılmıştır Anahtar kelimeler: adli kontrol, koruma tedbiri, tutuklama, ölçülük ilkesi
