Medeni yargılamaya hakim ilkeler ışığında ilk derece yargıcının yetkileri

Abstract

Çalışmamızın ilk bölümünde hâkimlik statüsü ve yargılamaya egemen olan ilkelerin tasnifi üzerinde durduk. Yargılamaya egemen ilkelerin sınıflandırılmasında benimsediğimiz görüşe göre, ilkeler ikiye ayrılmaktadır. İlk grup, Anayasa'da da ifadesini bulan kamusal ve evrensel ilkeler olup; bu ilkeler kanunkoyucunun tercih ettiği hukuk politikasından bağımsız olarak her yargılama usulünde uygulanır. İkinci grup ise 'yargılama tekniğine yönelik ilkeler'dir. Bunlar bir hukuk politikası sorunu olup; her yargılama usulünde uygulanmak zorunda değildir. Çalışmamızın ikinci bölümünde kamusal, evrensel ilkeler bağlamında yargıcın yetkilerini inceledik. Bu ilkeler: hukuki dinlenilme hakkı, aleniyet ilkesi, usul ekonomisi ilkesi, silahların eşitliği ilkesidir. Bu ilkeler hakkında kısaca bilgi verdikten sonra, bu ilkeleri yaşama geçirmek için hâkimin sahip olduğu yetkileri ve bu ilkelerin hâkime nasıl bir hareket serbestisi tanıdığını inceledik.Çalışmamızın son kısmı olan üçüncü bölümünde ise yargılama tekniğine yönelik ilkelerden ne anlaşılması gerektiğini kısaca ele aldıktan sonar bu ilkeler bağlamında yargıcın yetkilerini inceledik. Bu yetkiler: taraflarca getirilme ilkesi, tasarruf ilkesi, yargılamanın sevk ve idaresi, taleple bağlılık ilkesidir.

In the first part of our work, we focused on the classification of the principles that dominate the judge status and the judiciary. According to the opinion we have adopted in the classification of the principles governing the judiciary, the principles are divided into two. The first group is the public and universal principles that are expressed in the Constitution as well; these principles apply in every judicial procedure, regardless of the legal policy preferred by the law-maker. The second group is technical principles for the judiciary. These do not have to be applied in every judicial procedure. In the second part of our work, we examined the competence of the judge in the context of public, universal principles. These principles: the right to legal hearing, the principle of publicity, the principle of judicial economy, the principle of equality of parties. After giving brief information on these principles, we have examined the authorities that the judge has in order to implement these principles and how these principles recognize the freedom of action.In the third part, which is the last part of our study, we briefly discussed what principles should be understood from the trial technique, and afterwards we examined the competence of the judge in the context of these principles. These powers: the principle of bringing by parties, disposition maxim(The Principle of the parties' control), management of the trial and discipline, principle of being bound by the scope of demand.
