Kişiliğin korunması kapsamında kişisel verilerin hukuka aykırı kullanılması nedeniyle hukuki sorumluluk / Legal liability for unlawful use of personal data within the scope of protection of personality

Abstract

Kişisel veri, kimliği belli veya belirlenebilir gerçek kişiye ilişkin her tür bilgidir. Kişisel veriler üzerinde gerçekleştirilen her tür işlem, işleyenin bu işlemi gerçekleştirme yetkisi yoksa hukuka aykırı nitelik taşıyacaktır. Kişisel verilerin hayatımızın her alanına nüfuz etmiş olması sebebiyle kişisel veriler, gündelik hayatın içerisinde sıklıkla işlenmektedir. Söz konusu işleme faaliyetinin hukuka aykırı nitelik taşıması ortaya çıkan sorumluluk ve doğacak sorumluluk rejiminin belirlenmesi önem taşır. Disiplinler arası bir alan olan kişisel verilerin korunması hukukunun önemi, günümüz dünyasındaki hızlı teknolojik gelişim ve ilerlemelerle daha da artmaktadır. Bu alana ilişkin pek çok mesele, farklı hukuk dalları tarafından ele alınmakta ve teknolojik gelişmeler ile hukuk arasında bağ kurulmaya ve söz konusu yenilikler hukuki çerçevede anlamlandırılmaya çalışılmaktadır. Çalışmamızda kişisel verilerin hukuka aykırı işlenmesi halinde ortaya çıkan sorumluluk, özel hukuk boyutuyla ve haksız fiil sorumluluğu bakımından ele alınacaktır. Personal data is any information relating to an identified or identifiable natural person. Any operation performed on personal data shall be unlawful if the processor is not authorized to perform such an operation. Due to the fact that personal data has spread into every aspect of our lives, personal data is frequently processed in daily life. It is important to determine the liability arising from the unlawful nature of the processing activity in question and the liability regime that will arise. The importance of personal data protection law, which is an interdisciplinary field, is increasing with the rapid technological development and progress in today's world. Many issues related to this field are handled by different branches of law and an attempt is made to establish a link between technological developments and law and to make sense of these innovations within the legal framework. In our study, the liability arising in case of unlawful processing of personal data will be discussed in terms of private law and tort liability.
