Abstract

Cancellation of testamentary dispositions constitutes the subject of this thesis. Both the special provisions in the Turkish Civil Code, which are related to the cancellation of testamentary dispositions, and the relevant general provisions in the Turkish Code of Obligations are dealt together in the thesis and thereby, efforts are made to ensure the integrity of the subject. There are only a few relevant studies in the doctrine. Therefore, in order to make the matter comprehensible and be helpful as to the practice, the related case studies, precedents and jurisprudences in the practice are submitted and dealt as far as possible, in this study. In the first chapter of this study, testamentary dispositions are dealt on the basis of their general characteristics and the kinds of testamentary dispositions are mentioned. In that chapter, the way of how testamentary dispositions are regulated in the law is mentioned, and their contents as well as the related requirements as to form are dwelt upon. In the second chapter, the cases of cancellation and invalidity of testamentary dispositions are explained. In that chapter constituting the main subject of the study, particularly the grounds and consequences of such cancellation are explained comparatively with regard to the Obligations Law and the Inheritance Law. Considering the fact that there are differences in case a cancelled testamentary disposition is a testament or an inheritance contract; the matter is dealt separately with regard to testaments and inheritance contracts. Finally, in the third chapter of our study, action for nullity (or will contest) is dealt briefly. In particular, the term of litigation for these actions is dealt due to its significance. In the study, particularly the errors/mistakes observed in the practice are also mentioned and thereby, efforts are made to discuss the matter. Keywords 1. Testamentary dispositions. 2. Tezde, hem Türk Medeni Kanunu'ndaki ölüme bağlı tasarrufların iptali hakkındaki özel hükümler, hem de Türk Borçlar Kanunu'ndaki konuya ilişkin genel hükümler birlikte değerlendirilerek konu bütünlüğü sağlanmaya çalışılmıştır. Doktrinde pek az incelenmiş olan konuyu anlaşılabilir kılmak ve uygulamada faydalı olabilmek amacıyla, çalışmada mümkün olduğunca uygulamadan örnek olay ve içtihatlara yer verilmiştir. Çalışmanın ilk bölümünde, ölüme bağlı tasarruflar, genel özellikleriyle ele alınmış; ölüme bağlı tasarruf çeşitlerinden söz edilmiştir. Bu bölümde, ölüme bağlı tasarrufların kanundaki düzenleniş biçimine yer verilmiş, içerik ve şekil şartları üzerinde durulmuştur. İkinci bölümde ise ölüme bağlı tasarrufların iptali ve geçersizliği halleri anlatılmıştır. Çalışmanın ana konusunu oluşturan bu bölümde, özellikle iptal sebepleri ile sonuçları, Borçlar Hukuku ile Miras Hukuku açısından karşılaştırmalı olarak anlatılmıştır. İptal konusu edilen ölüme bağlı tasarrufun vasiyetname ya da miras sözleşmesi olması halinde farklılıklar gösterdiği dikkate alınarak, konu, vasiyetnameler ve miras sözleşmeleri yönünden ayrı ayrı ele alınmıştır. Nihayet, çalışmamızın üçüncü bölümünde ise, iptal davası kısaca ele alınmış, önemi sebebiyle, özellikle davanın açılabileceği süre üzerinde durulmuştur.
