Çek hukukunda başvurma hakkı

Abstract

The right to petition for the bearer is the right of the check holder collects to check – based receivable upon non-payment of the check amount. For the right to petition arise, check holder has to fulfill certain tangible and formal conditions. A debtor, who pays the check amount voluntarily of forcibly, is going to have the right to petition for the bearer.

Başvurma hakkı, çek bedelinin ödenmemesi üzerine hamilin çeke dayalı alacağını tahsil edebilmek için sahip olduğu bir talep hakkıdır. Başvurma hakkının doğması için hamilin belirli maddi ve şekli koşulları yerine getirmesi gerekir. Bu koşulları yerine getiren hamil, müteselsil borçlu sıfatıyla sorumlu olan başvuru borçlularına karşı sahip olduğu başvurma hakkını kullanır. Başvurma hakkının kullanılması sebebiyle rızaen veya cebren ödeme yapan herhangi bir başvuru borçlusu da başvurma hakkına sahip olur.
