Abstract

5510 sayılı Kanun'un 14, 21, 23, 39 ve 76. maddelerinde düzenlenen Sosyal Güvenlik Kurumunun rücu hakkı, Sosyal Güvenlik Hukuku alanında en çok uyuşmazlık yaşanan konulardan biridir. Bu nedenle Kuruma, Kanun'un çeşitli maddelerinde tanınan rücu hakkının, hangi hallerde doğduğunun, niteliğinin ve kapsamının tespit edilmesi önem taşımaktadır. Bu çalışmada, 5510 sayılı Sosyal Sigortalar ve Genel Sağlık Sigortası Kanunu'nda Kuruma tanınan rücu hakkı ayrıntılı olarak incelenmiştir. Konunun anlaşılmasını sağlamak amacıyla doktrin görüşleri, Yüksek Mahkeme kararları ve örnek olay uygulamalarına yer verilmiştir.

The right of repatriation of the Social Security Institution, which is organized in Articles 14, 21, 23, 39 and 76 of Law No. 5510, is one of the most disputed issues in the field of Social Security Law. For this reason, it is important for the Institution to determine the nature, extent and scope of the recourse granted in the various articles of the Law. In this study, the right of recourse granted to the Institution in Social Insurance and General Health Insurance Law No. 5510 has been examined in detail. Doctrine opinions, Supreme Court decisions and case studies have been included in order to ensure understanding of the matter.
