Karayolları Motorlu Araçlar Zorunlu Mali Sorumluluk Sigortasında sigortacının sigorta ettirene rücu hakkı

Abstract

During the operation of a motor vehicle, the person operating the vehicle or considered as the operator is obligated to cover the damages arising from a traffic accident. Therefore, according to the Highway Traffic Law No. 2918, operators are required to have compulsory motor vehicle liability insurance for road traffic. In the event of damage caused by a traffic accident, the third party affected has the direct right to demand and file a lawsuit against the insurer, limited to the insurance amount specified in the compulsory motor vehicle liability insurance contract established between the insured and the insurer. The insurer who compensates the damage of the third party can seek recourse against the insured for the compensation paid under certain conditions. Our study, which addresses the instances of the insurer's recourse to the insured, consists of four parts. The first part is introduction. In the second part, the general principles, historical development, parties involved, and the violation of obligations regarding compulsory motor vehicle liability insurance for road traffic are extensively discussed. The third part attempts to provide a detailed explanation of the insurer's recourse right and the situations in which this right can be exercised. Finally, the fourth part evaluates the insurer's recourse lawsuit against the insured, the competent and authorized court, alternative dispute resolution methods, and the statute of limitations, offering solutions and recommendations on the subject.

Bir motorlu aracın işletilmesi esnasında meydana gelen trafik kazasından doğan zararları, motorlu araç işleteni veya işleten sayılan kişi, gidermek zorundadır. Bu nedenle, 2918 sayılı Karayolları Trafik Kanunu uyarınca işletenlerin karayolları motorlu araçlar zorunlu mali sorumluluk sigortası yaptırması mecburi hale getirilmiştir. Trafik kazası sonucunda zarar gören üçüncü kişi, sigorta yaptıran kişi ile sigortacı arasında kurulan zorunlu mali sorumluluk sigortası sözleşmesinde belirlenen sigorta tutarıyla sınırlı olarak, sigortacıya karşı doğrudan talep ve dava hakkına sahiptir. Üçüncü kişinin zararını gideren sigortacı, koşulların oluşması halinde sigortalıya ödediği tazminatı rücu edebilir. Sigortacının sigortalıya rücu hallerini ele alan çalışmamız dört bölümden oluşmaktadır. Birinci bölümde, konuya giriş yapılmış; ikinci bölümde karayolları motorlu araçlar zorunlu mali sorumluluk sigortasının genel esasları, hukuki niteliği ve tarafları detaylı bir şekilde ele alınmıştır. Üçüncü bölümde, sigortacının rücu hakkı ve bu hakkın hangi hallerde kullanılabileceği detaylı bir şekilde açıklanmaya çalışılmıştır. Son olarak dördüncü bölümde ise, sigortacının sigortalıya rücu davası, görevli ve yetkili mahkeme; alternatif uyuşmazlık çözüm yolları ve zamanaşımı açısından değerlendirilerek konuya dair çözüm ve öneriler sunulmuştur.
