Abstract

Küresel dünyadaki rekabet ortamı, ticari hayatın devamlılığı, ekonomik piyasalar, her gün gelişen teknoloji, ülkelerin ekonomi politikaları gibi gelişmeler nedeniyle şirketler birleşme, bölünme ve tür değiştirme yollarına başvurmak durumunda kalmaktadırlar. Şirketlerdeki yapısal değişikler ile işyeri devri meydana gelmesi nedeniyle işyerinde çalışan işçiler de etkilenmektedir. Bu doğrultuda, çalışmamızda şirketlerdeki yapısal değişiklik hallerinde iş ilişkilerinin durumu, işçilik alacakları, işçinin hakları, işverenlerin sorumlulukları, kanunlardaki düzenlemeler ve içtihatlarla birlikte ele alınmıştır. Çalışmanın birinci bölümünde işyerindeki birleşme, bölünme ve tür değiştirme halleri irdelenmiş, ikinci bölümünde işyeri ve işyerinin devri açıklanmıştır. Son bölümünde ise şirketlerin birleşmesi, bölünmesi ve tür değiştirmesi durumlarında işyeri devrinin iş ilişkilerine etkisi ele alınmıştır. Due to developments such as the competitive environment in the global world, the continuity of commercial life, economic markets, ever-evolving technology, and the economic policies of countries, companies have to resort to ways of merger, division and type change. Workers working in the workplace are also affected due to structural changes in companies and workplace turnover. In this direction, in our study, the status of business relations in case of structural changes in companies, labor claims, rights of workers, responsibilities of employers, regulations in laws and case law are discussed. In the first part of the study, the cases of merger, division and type change in the workplace were examined, and in the second part, the workplace and the transfer of the workplace were explained. In the last part, the effect of workplace transfer on business relations in cases of merger, division and type change of companies is discussed.
