Comparison of Parliamentary System and Presidential System

Abstract

Çalışma derleme yönteminde hazırlanmış olup, bu konuda bilimsel yayınlar, makale, dergi vb. materyallerden faydalanılmıştır. Çalışma üç ana bölümden oluşmaktadır: Çalışmanın birinci bölümünde Türkiye'de uygulanan yönetim sistemleri sırasıyla 1876 Anayasası, 1921 Anayasası, 1924 Anayasası, 1961 Anayasası ve 1982 Anayasası çerçevesinde açıklanmış, ardından Türkiye'nin parlamenter yönetim sisteminin değerlendirilmesi çerçevesinde parlamenter sistemin tanımı, tarihçesi ve unsurlarına yer verilmiştir. Bu bölümde son olarak Türk Parlamenter sistemine ilişkin genel değerlendirmeler açıklanmıştır. İkinci bölümde; başkanlık sisteminin tanımı, tarihçesi, yapısı ve özellikleri ile Amerika Birleşik Devletleri'ndeki uygulaması açıklanmış, başkanlık sisteminin avantajları ve dezavantajlarına ilişkin değerlendirmelere yer verilmiştir. Nihayet çalışmanın üçüncü bölümünde başkanlık sistemi ile parlamenter sistem yürütme, yasama ve yargı boyutlarında farklı ülkelerden de atıflarda bulunularak karşılaştırılmaya çalışılmıştır.

The study was prepared in the compilation method and scientific publications, articles, journals, etc. were published in this subject. materials were used. The study consists of three main parts: In the first part of the study the Republican Era management systems, respectively 1876 and 1921 Constitution applied throughout Turkey, the 1924 Constitution, the 1961 Constitution and explained in the framework of the 1982 Constitution, then the definition of a parliamentary system in the framework of the evaluation of Turkey's parliamentary management system, history and elements of the are included. In this section, the general evaluations regarding the Turkish Parliamentary system are explained. In the second part, the definition, history, structure and characteristics of the presidential system and its application in the United States are explained and the advantages and disadvantages of the presidential system are discussed. Finally, in the third part of the study, the Presidential system and the parliamentary system were tried to be compared by making references from different countries in terms of executive, legislative and judicial dimensions.
