Türk Hukukunda ceza infaz kurumları ve bu kurumlarda bulunan tutuklu ve hükümlülerin hak ve yükümlülükleri

Abstract

The aim of this study is to display the final status of the crime and penal institutions in Turkey, within the historical development process and the rights and the obligations of the prisoners, within the national and international dimensions. As an arrestment and execution of the penalty is a limitation to the right to liberty and security, which is a constitutional right, in first section, the right to liberty and security is examined within the national and international dimensions and in the second section it is mentioned about the historical development and kinds of penalties, which is the subject of the execution. After the third section in which execution of the penalty is examined, the study is ended by researching the rights and the obligations of the prisoners, according to national and international regulations in the last section. Çalışmanın temel amacı, Türkiye'de var olan infaz kurumlarının tarihsel gelişim süreçleri içerisinde nihai durumlarının ve bu kurumlarda bulunan tutuklu ve hükümlülerin sahip oldukları hak ve yükümlülüklerin, ulusal ve uluslararası boyutu ile ortaya konulmasıdır. Tutuklama ve cezaların infaz edilmesi, anayasal bir hak olan kişi hürriyeti ve güvenliği hakkına yönelik bir sınırlama oluşturduğu için, birinci bölümde kişi hürriyeti ve güvenliği hakkı, ulusal ve uluslararası boyutuyla ele alınmış, ikinci bölümde infazın konusu olan ceza kavramının tarihsel gelişimi ve türlerine değinilmiştir. Üçüncü bölümde cezaların infazı inceleme konusu yapıldıktan sonra son bölümde de ceza infaz kurumlarında bulunan tutuklu ve hükümlülerin ulusal ve uluslararası düzenlemeler çerçevesinde sahip oldukları hak ve yükümlülükler incelenerek çalışmaya son verilmiştir.
