Abstract
6100 Sayılı Hukuk Muhakemeleri Kanunu'nun 01/10/2011 tarihinde yürürlüğe girmesi ile birlikte hukuk dünyamız yeni bir dava türü ile tanışmıştır. Belirsiz Alacak Davası uygulamada birçok sorunun ortaya çıkmasına yol açmış görünmektedir. Sorunların önemli bir kısmı da iş yargısında yaşanmıştır. Fakat hemen belirtelim ki, konuyla ilgili sorunlar halen devam etmektedir. Çok farklı öğreti görüşlerinin yanında Yargıtay'ın işçilik alacaklarına bakan daireleri arasında da ciddi görüş ayrılıkları yaşanmaktadır. Bu durum aynı konuda farklı kararların verilmesine neden olmaktadır. Yargıtay dairelerinin aynı konuda farklı kararların altına imza atmaları ise, çoğu kez davacıları yani işçileri olumsuz etkilemekte, onların mağduriyetine sebep olmaktadır. Çalışmada, Belirsiz Alacak Davaları, bu davaların özellikleri, Belirsiz Alacak Davası'nın diğer dava türleriyle ilişkisi konularına temas etmenin yanı sıra, İşçilik Alacaklarında Belirsiz Alacak Davası'na ilişkin bilimsel görüşler ve Yargıtay dairelerinin vermiş oldukları farklı kararları aktarılmıştır.
On 1 October 2011, Law No. 6100 on Civil Procedure entered into force. In connection with this, our legal World has met with a new kind of lawsuit: Uncertain Receivables Lawsuit. To be honest, the Uncertain Receivables Lawsuit seems to have led to many problems in practice. An important part of these problems was experienced in labor judiciary. But let us point out that these problems still persist. The interesting side of the work is that, apart from the many different doctrine views, there are also serious differences of opinion among the Supreme Court's offices which take care of labor. This leads to different decisions on the same time issue. The fact that the Supreme Court offices make different decisions on the same time subject often affects the plaintiffs, the workers, and causes them to suffer. In this study, we discussed the cases of uncertain receivables, the characteristics of these cases and the relationship of the case of uncertain receivables with other types of cases. In addition, we wanted to expose the scientific opinions regarding the cases of uncertain receivables in labor receivables and the different decisions of the Supreme Court Offices.
