Yanlış teşhis ve tedavide hekimin hukuki sorumluluğu

Abstract

Tez üç bölümden oluşmakta olup, öncelikle hasta haklarının tarihsel gelişimi, akabinde de hasta ile hekim, hekim ile hastane ve hastane ile hasta arasındaki ilişkinin hukuki niteliği incelenmiştir. Taraflar arasındaki ilişki belirlenmeden, meydana gelebilecek olumsuz durumların hangi hukuki hükümlere göre çözümleneceği hususunda karışıklıklar ortaya çıkabileceğinden, çıkan ihtilafların hangi sözleşme hükümlerine ya da kanunda düzenlenen hangi sözleşme dışı müesseseye göre çözümleneceği hususunun belirlenmesi önem arzetmektedir. Hekimin teşhis ve tedavi yükümlülüğü, malpraktis kavramı, hekimin yanlış tanı koyması, tedaviyi veya cerrahi müdahaleyi hatalı bir şekilde gerçekleştirmesi hususları da irdelenmiş olup, hekimin müdahalesinin zorunlu olup olmaması, tedavi sonucunda ortaya çıkabilecek olumsuz durumun hekimin ihmali veya hatası sonucu mu yoksa her tedavide veya cerrahi müdahalede ortaya çıkabilecek komplikasyonlardan, risklerden mi olduğunun tespit edilmesi kavramları incelenmiştir. Tezin son bölümünde, hekimin tıbbi uygulama hatası neticesinde karşı karşıya kalacağı özel hukuktan kaynaklanan sorumluluğu incelenmiştir. Hekimin kastı, ihmali veya kusurunun olduğu veya kendi denetim ve gözetiminde çalışan sağlık personelinin hatasından kaynaklanan olumsuzluklar karşısında ne gibi yükümlülükleri olduğu, hangi yaptırımlarla karşı karşıya kalabileceği irdelenmiştir.

The thesis consists of three parts, the historical development of patient rights, and the legal nature of the relationship between patient and physician, physician and hospital, and hospital and patient. Since there may be confusion as to the legal provisions to be used for the resolution of the disputes if the relationship between the parties is not determined, it is important to determine the provisions of the contract or the non-contract principles regulated by the law to be used for the resolution of the disputes. The subjects such as the physician's obligation to diagnose and treat, the concept of malpractice, the wrong diagnosis of the physician, the wrong performance of the treatment or the surgical intervention were examined, and whether the physician's intervention is necessary or not, whether the adverse situation that may arise as a result of the treatment is due to the negligence or fault of the physician or the complications or the risks that may occur in every treatment or surgical intervention were investigated. In the last part of the thesis, the responsibility of the physician due to private law as a result of medical malpractice was examined. The responsibilities of the physician regarding the intention, negligence or fault of the physician or the adversities caused by the fault of the healthcare personnel working under his/her supervision, and the sanctions which may be faced were addressed.
