Toplu iş sözleşmesinde yetki

Abstract

Bu çalışmada toplu iş sözleşmesi yetkisi üzerine İş Hukuku Mevzuatı, Sendikalar ve Toplu İş Sözleşmesi Mevzuatı, Uluslararası Çalışma Örgütü Sözleşmeleri ve Yargıtay kararları kapsamında hukuki bir değerlendirme yapılmıştır. Çalışmamız beş bölümden oluşmaktadır. İş ilişkisinin taraflarını oluşturan işçi ve işveren arasında başından beri var olan sosyo-ekonomik güç farkı, sanayi devrimi ve sonrasında yaşanan gelişmeler sonucunda işveren lehine derinleşmiştir. İşçiler, işverenin karşısına birey olarak değil; örgütlenmiş topluluklar halinde çıkarak bu duruma çare aramıştır. Toplu iş sözleşmesi, işçi sendikası ile işveren veya işveren sendikası arasındaki toplu pazarlık sürecinin bir sonucudur. Çalışmamızda toplu iş sözleşmesinin temel taşlarından olan yetki kavramı kapsamlı bir şekilde ele alınmıştır. Özellikle yetki tespiti başvuru süreçleri, yetki tespitine itiraz mekanizmaları ve yargı kararları incelenerek mevcut yetki prosedürünün işlevselliği incelenmiş, elde edilen görüşler ve çözüm önerileri sunularak değerlendirme yapılmıştır. Çalışmamızın temel amacı, sendikaların yetki süreçlerini daha etkin ve verimli şekilde yürütebilmelerine katkı sağlayarak işçi ve işverenlerin haklarını güvence altına almaktır. In this study, a legal assessment was made on the authority of collective bargaining within the scope of Labor Law Legislation, Trade Unions and Collective Bargaining Legislation, International Labor Organization Conventions and Supreme Court decisions. Our study consists of five sections. The socio-economic power disparity between the employee and the employer, which has existed from the outset of the employment relationship, has deepened in favor of the employer as a result of the Industrial Revolution and subsequent developments. Workers have sought solutions to this imbalance not as individuals but as organized communities. Collective bargaining agreement is the outcome of the collective bargaining process between a workers' union and the employer or the employers' union. In this study, the concept of authorization, which is one of the cornerstones of the collective bargaining agreement, was examined in detail. In particular, the application processes for the determination of authority, the mechanisms of objection to the determination of authority and judicial decisions were examined, the functionality of the existing authorization procedure was examined, opinions and the solution suggestions obtained were presented and evaluated. The primary objective of our study is to contribute to enabling trade unions to manage authority processes more effectively and efficiently, thereby securing the rights of both workers and employers.
