Kamu hizmetinde dijital dönüşüm ve e-ihale süreci / Digital transformation in the public service and the process of e-procurement

Abstract

Kamu hizmeti, toplumsal ve teknolojik gelişmeler sonucunda değişime uğramış ve dönüşmüştür. Bu dönüşüm sonucunda kamu hizmetleri dijitalleşmiş, e-devlet hizmetleri olarak da ifade edilen dijital kamu hizmetleri ortaya çıkmıştır. Kamu hizmetinin dijitalleşmesi ile e-devlet kullanımı yaygınlaşmış, kamu hizmetine hakim olan ilkeler de bu değişimden etkilenmiş ve yeni kamu hizmeti ilkeleri ortaya çıkmıştır. Kamu harcamalarının içerisinde oldukça fazla paya sahip olan kamu ihalelerinde, rekabet, saydamlık, güvenirlik, eşit muamele, kamuoyu denetimi, gizlilik, kaynakların verimli kullanılması ve ihtiyacın uygun şartlarla ve zamanında karşılanması ilkelerinin gereklerinin sağlanması ve kamu hizmetinin yerine getirilmesi amacıyla hareket edilmektedir. Bu amaçlarla AB Direktifleri doğrultusunda dijital kamu hizmetlerinden biri olan e-ihale uygulaması benimsenmiştir. E-ihalenin benimsenmesiyle kamu ihalelerine egemen olan ilkelerin gerekleri de yerine getirilerek, klasik ihaleye göre oldukça fayda elde edilmiştir. E-ihale ile ihalenin konusunun tespit edilerek ihtiyaç raporunun hazırlanmasından, sözleşmenin imzalanmasına kadar tüm aşamalar elektronik ortamdan gerçekleştirilebilmektedir. E-ihalenin yaygınlaştırılması çalışmaları devam etmektedir. Son mevzuat değişikliği ile de belirli ihalelerde, e-ihalenin uygulanması zorunlu hale getirilmiş, bu durum da e-ihalenin önemini daha da arttırmıştır. Public service has changed and transformed as a result of social and technological developments. As a result of this transformation, public services have become digital, and digital public services, also known as e-government services, have emerged. With the digitalization of the public service, the use of e-government has become widespread, the principles that dominate the public service have also been affected by this change and new public service principles have emerged. In public procurements, which have a large share in public expenditures, actions are taken with the aim of meeting the requirements of the principles of competition, transparency, reliability, equal treatment, public scrutiny, confidentiality, efficient use of resources and meeting the needs under appropriate conditions and on time, and fulfilling the public service. For these purposes, e-procurement application, which is one of the digital public services, has been adopted in line with EU Directives. With the adoption of e-procurement, the requirements of the principles that dominate public procurements have also been fulfilled, and great deal of benefit has been obtained compared to the classical procurement. With e-procurement, all stages from determining the subject of the procurement and preparing the requirement report to signing the contract can be carried out electronically. Dissemination efforts of e-procurement are continuing. With the latest legislative amendment, the implementation of e-procurement in certain procurements has become mandatory, which has further increased the importance of e-procurement subject.
