Ceza muhakemesi hukukunda görev bakımından yetki kuralları çerçevesinde sulh ceza hâkimliklerinin değerlendirilmesi

Abstract

This study assesses the theoretical and practical issues relating to the criminal judgeships of magistrates, which have been part of the criminal justice system since 2014 and have played a very important role in investigations in criminal proceedings since their establishment. The study analyses the legal status and function of the criminal judgeships of magistrates, discusses their position in the criminal justice system, their jurisdiction and the limits of their duties. The decisions of the magistrates judges are explained and the problems encountered in practice are identified. Finally, proposals are made for the more effective exercise of the powers of these judgeships in relation to their duties.

Çalışmamızda 2014 yılında ceza yargılaması teşkilatına giren ve kurulduğu günden itibaren ceza muhakemesinde soruşturmalarda oldukça önemli bir rol oynayan sulh ceza hâkimlikleri ile ilgili teoride ve uygulamada ortaya çıkan sorunlara ilişkin değerlendirmeler yapılmıştır. Çalışmada sulh ceza hâkimliklerinin hukuki statüsü ve işlevi incelenmiş, ceza muhakemesi sistemindeki konumu, yetki alanları ve görev sınırları ele alınmıştır. Sulh ceza hâkimliklerinin verebileceği kararlar açıklanarak, uygulamadaki sorunlar ortaya konmuştur. Son olarak, bu hâkimliklerin görev bakımından yetkilerinin daha etkili yürütülebilmesi için öneriler sunulmuştur.
