Bilgisayar programlarındaki değişikliklerin Fikrî Hukuk kapsamında değerlendirilmesi

Abstract

Fikrî hukuk korumasındaki eserlerden biri olan bilgisayar programları, diğer eserlere göre birçok açıdan sıra dışı özellikler içermektedir. Programların etkin bir şekilde yaşamlarını devam ettirebilmeleri için hayatın değişen koşullarına uyum sağlamak zorunda oldukları bir gerçektir. Biz de çalışmamızda bu gerçekten yola çıkarak, bilgisayar programlarında ortaya çıkan değişiklikler neticesinde, özellikle eser sahipliği kapsamında doğacak hukuki sonuçları değerlendirmeye çalıştık. Konu, üç bölüm halinde incelenmiştir. Tezin ilk bölümünde, temel kavramlar olan fikrî hak ve eser kavramları üzerinde durulduktan sonra, fikrî hakkın kısa tarihsel gelişimi ile kavramın hukuki niteliğini açıklamaya çalışan teoriler incelenmiştir. İkinci bölümde, bilgisayar programlarının temel teknik kavramları açıklanmaya çalışılmış, 1995 Yılında yürürlüğe giren 91/250 Sayılı Bilgisayar Programlarının Hukuki Korunması Direktifi' ile birlikte hukukumuzda programların eser olarak nasıl korunduğu hususu üzerinde durulmuştur. Üçüncü bölümde ise bilgisayar programlarında gerçekleştirilen değişiklikler (güncellemeler, versiyonlar vs) teknik olarak değerlendirildikten sonra bu değişikliklerin eser sahipliği üzerine etkileri yasal düzenlemeler kapsamında değerlendirilmiştir. Sonuç kısmında ise, genel olarak değişikliklerin değerlendirilmesi ve fikrî hukuk kapsamında doğacak hukuki sonuçlara ilişkin görüşlerimiz yer almaktadır. Computer Programs which are under the protection of copyright law have peculiar features compared to the other species. It is obvious that computer programs must comply with the changing conditions of life in order to maintain their effectiveness. Based on this fact, the subject of this study is to examine the legal consequences, particularly related to the ownership of the intellectual work, arising from the changes in the computer programs. The topic is divided into three main chapters. In the first chapter, after examining basic concepts of copyright law such as intellectual right and intellectual works, a brief history and the theories explaining the legal feature of the intellectual right is analyzed. Second chapter seeks to explain basic technical concepts and examines how computer programs are legally protected under the copyright law in Turkish Legislation in line with the Council Directive of 14 May 1991 on The Legal Protection of Computer Programs 91/250 which entered force in 1995. The last but not the least, the third part analyzes the technical evaluation of changes (updates, versions, etc.) and examines the impacts of these changes on the ownership of the work under the legislation in line with the EU Directive. The conclusion consists of general assessments on changes of computer programs and the legal consequences arising from these changes in the scope of Intellectual Property Law and gives a place to the writer's own opinions related to this issue.
