FATİH KURDOĞLU2025-09-032022https://gcris.yasar.edu.tr/handle/123456789/754ÇED yapılması planlanan projenin çevreye olası muhtemel etkilerini göstermek, projenin onay verilmeden önce ekonomik, sosyal ve çevresel etkilerini tespit etmek, olası etkilerin nasıl ortadan kaldırılacağına ilişkin çözümlerin sunulduğu, inşaat ve işletme sürecini anlatan disiplinlerarası bir çevre yöntemidir. ÇED süreciyle projenin çevresel zararlarının tespiti sağlanacak ve çevre kirliliğinin önlenmesi için alınacak tedbirler hazırlanacaktır. Çevrenin korunmasının temel dayanağı olan çevre hakkının gerçekleştirilmesini sağlayan teknik bir araçtır. Çalışmamızın ilk bölümünde çevre kavramına, çevre hakkının çevreyle olan ilişkisine, çevre hakkının yerel ve uluslararası mevzuatta gelişimine, ÇED kavramının tanımlanmasına, ÇED'in çevre hakkıyla ve diğer temel haklarla ilişkisine, ÇED'in uluslararası hukukta ve yerel hukukta ki gelişimine yer verilmiştir. Çalışmamızın ikinci bölümünde ise ÇED sürecine ve hukuki etkisine yer verilmiş, bir idari işlem olarak ÇED'in hukuki niteliği, ÇED idari işleminin unsurları açısından ve yapılış usulü ayrıntılı biçimde anlatılmış, ÇED idari işleminin tabi olduğu idari usul ilkeleri ve özellikle katılım ilkesi değerlendirilmiş ve ÇED süreci sonucunda verilen ÇED kararlarına yer verilmiştir. Çalışmamızın üçüncü ve son bölümünde ise, ÇED süreci sonunca verilen kararlara karşı görevli ye yetkili yargı yerinin belirlenmesi konuları ele alınmış, ÇED kararlarına karşı açılacak iptal davasının tabi olduğu yargılama türüne yer verilmiş, iptal davası açılabilmesinin ön koşulları özellikle menfaat açısından değerlendirilmiş, yürütmenin durdurulması müessesesi ayrıntılı bir şekilde anlatılmış, yargı kararlarına uyulmamasının sonuçları ele alınmış ve ÇED kararlarının yargısal denetiminde AYM'nin ve Danıştay'ın yaklaşımı değerlendirilmiştir. Environmental Impact Assessment is an interdisciplinary method that shows the possible environmental consequences of the planned projects, learns the economic, social, and environmental impact of a project before its approval, suggests the solution to the possible negative outcomes, and explains the process of construction and operations. EIA provides environmental damage registration and environmental pollution prevention measures. It is a technical method that allows fulfilling the main right of the environment to defend itself. The first part of the work covers the definition of the environment as well as the relation of the environmental right to the environment, the development of the environmental right at local and on international levels, the introduction of the environmental impact assessment definition and its relation to the environmental and other fundamental rights, and also the place that environmental impact assessment takes in international and national laws. The second part of the work describes the process of the EIA and its legal impact, the legal qualification of EIA as an executive process, it describes the executive processes of the EIA both from the perspective of its elements and of the application procedures. It describes the implementation of the administrative process of EIA-associated principles and especially the evaluation of the principles of participation in the process. At last, the part includes the results of the EIA at the end of the assessment. The third and final part of the work includes the topic of the selection of the assigned and authorized place of jurisdiction for the decisions of the EIA process. The part includes a description of the proper cancellation lawsuit type against the EIA verdict, and a general and profit evaluation of the prerequisites for the lawsuit initiation. The establishment of the lawsuit process suspension also is explained in detail. This part also explains the consequences of contempt of court and describes the approach of the Supreme Court and Council of the Court of Audit to the EIA in the legal audit of the EIA.trMaster Thesis
