    In order to ensure international peace and security and to prevent future conflicts, the verification of disarmament has become an increasingly important issue for the international community, especially with the gradual development of weapon technologies used in the modern age and possibility of an armed conflict threatening the future of all humanity. Until the XXth century, disarmament attempts were irregular and usually within the framework of peace treaties or in the form of future treaty and protocol proposals, and for this reason, they did not last long. Although steps were taken to ban and limit certain types of weapons until the end of World War II, an effective verification mechanism could not be implemented. Agreements regulating disarmament and establishing effective control mechanisms could only be possible after the adoption of the United Nations Charter at the end of World War II. The United Nations Charter and the first United Nations General Assembly resolutions, called upon member states to cooperate for the implementation of an effective mechanism for the verification of disarmament. Although States exhibited a willingness to act in cooperation in the field of disarmament after World War II, the post-war bipolar political order and the arms race that followed caused the initial hopes to fade soon after. As the Eastern and Western blocs did not act transparently in respect of their armament programs, the establishment of an effective verification regime could not be possible. However, the heavy economic burden of the arms race made States came to the conclusion that the limitation of armaments in a controlled manner was in their national interests. The first important disarmament treaties were in the form of bilateral treaties concluded between the USA and the USSR. This was followed by multilateral disarmament treaties and verification regimes supported by international organizations such as the International Atomic Energy Agency and the Organization for the Prohibition of Chemical Weapons in regard to their technical and financial aspects. The sudden drop in armament levels in the aftermath of Cold War created an optimistic environment reminiscent of the early years of the post-World War II era. Treaties, such as the Chemical Weapons Convention, which could not be completed for many years due to disagreements between the Eastern and Western blocs, entered into force. However, the optimistic atmosphere did not last long, and armament levels started to increase again as a result of the attacks of September 11th, 2001, and the global war against terrorism that followed. In this period, the main objective of the verification of disarmament was to ensure the implementation of methods and programs aiming to prevent the acquisition of weapons of mass destruction by non-state actors. The Arms Trade Treaty, which entered into force in 2014, reflects this new approach. Today, there is a mixed situation as regards the verification of disarmament. Despite effective and modern verification regimes that benefit from technological developments, the success of verification still largely depends on the effective participation and transparent conduct of States.     Cicero baba katliyle itham edilen Ameria’lı Sextus Roscius’un\rsavunmasını üstlenerek yirmi yedi yaşındayken ilk defa bir ceza davasında\rgörev aldı (M.Ö. 80). Cicero’nun senatörlerden oluşan bir jüri ihtivâ eden\rdâimî bir mahkeme (quaestio perpetua) önünde görülen bu ilk kamu davası\r(causa publica) gayrı insânî bir îdamla cezalandırılabilecek parricidium\rsuçuna ilişkin olmanın ötesinde siyâsî açıdan da hassâsiyet arz etmekteydi.\rRoscius davası iç savaşın neden olduğu toplumsal kargaşanın etkilerinin\rsürdüğü bir dönemde görüldü. Sulla rejiminin getirdiği siyâsî kurumsal ve\rsosyal dönüşümlerin yarattığı zemine oturan bu dava cumhuriyetin krizine ve\rRoma ceza yargılamasının gelişimine ışık tutması nedeniyle önem\rtaşımaktadır. Müvekkilinin berâat etmesini sağlayan Cicero’ya büyük îtibar\rve şöhret kazandıran bu dava netîcesinde genç hatip her türlü dava için yetkin\raddedilir oldu.

    İdarî İşlem Kavramının Tanımlanmasında Ölçütler Sorunu

    İdarenin faâliyeti eylemler ve hukukî sonuçlar yaratma iradesini ifâde eden işlemler vâsıtasıyla gerçekleşir. İdare faâliyetinin etkili sûrette yürütülmesi için idarenin eylemlere girişmesi bir zorunluluktur. Bununla beraber idare faâliyeti büyük ölçüde idarî işlemler temelinde yürütülür. Dolayısıyla idarî işlem kavramının tanımlanması idare faâliyetinin yürütülüş tarzını anlamak kadar yönetilenlerin haklarının idarî yargı yoluyla korunması açısından önem arz eder. İdarî işlem kavramı öncelikle işlemi yapan makamın idarî niteliğiyle açıklanabilir. Ancak kavramın kapsamının tespitinde bu yaklaşımın yetersiz kalması işlevsel bir ölçütün dikkate alınmasının yanında idarî işlemlerin kamu gücü ayrıcalıklarına dayanma özelliğinin açıklanmasını gerektirir. Bu doğrultuda makale idarî işlemlerin teşhisi için yargı mercileri tarafından hangi ölçütlerin kullanıldığını ve bu ölçütlerin nasıl uygulandıklarını açıklayarak idarî işlem kavramının genel bir tanımına ulaşmayı amaçlamaktadır.
