| dc.description.abstract | Medenî usûl hukukunda kesin hüküm kurumunun anlaşılabilmesi içinçalışmanın ilk bölümünde, hüküm ve karar kavramlarına yer verilmiş olupikinci bölümde kesin hükmün amacı, çeşitleri, unsurları ve son bölümde isekesin hükmün etkisi açıklanmaya çalışılmıştır. Boşanma davalarında kesinhüküm incelenirken boşanma davalarına ilişkin yaşanabilecek sorunlarailişkin değerlendirmelerde de bulunulmuştur. Konu ile ilgili Yargıtay HukukGenel Kurulu ve Yargıtay Hukuk Daireleri tarafından verilmiş güncelkararlardan da faydalanılmıştır. | tr |
| dc.description.abstract | In oder to comprehend the institution of res judicata, the terms of provision and decision in procedural law are handled in the first chapter of this study. The second chapter is devoted to the aim of res judicata, its types and elements. In the final chapter it is made an effort to explain the effects of res judicata. Whilst handling res Judicata in procedural law, also the probable troubles related to suits for divorce are interpreted. Furthermore the decisions of The Grand Assembly and Private Law Chambers of Turkish Appeal Court are made use in this study. | en_US |
