İdare Hukuku açısından elektrik ile ilgili hizmetlerin hukuki niteliği / Legal scope of electric services from the perspective of Administrative Law

Abstract

Elektrik enerjisi, birçok günlük faaliyette kullanılması zorunlu bir girdi haline gelmiştir. Tarım, taşıyıcılık ve ticari hayatın her alanında bugün elektrik kullanılmaktadır. Ekonomik ve sosyal kalkınmanın temel taşlarından birisi olmasının yanında son tüketici için hayati öneme sahiptir. Enerji, teknolojinin temeli ve gündelik yaşam için vazgeçilmez bir ihtiyaçtır. Enerji modern yaşamda ikamesi olmayan ve vazgeçilemeyecek bir nitelik taşımaktadır. Bu sebeple, yerel ve uluslararası arenada oldukça önemli bir yer tutar. Ülke ekonomisinin en önemli unsurlarından birisidir. Çalışmamızın ilk bölümünde elektriğin tanımı ve hukuki niteliği, keşfinden itibaren geçirdiği tarihsel süreç, elektrik hizmetlerinin türleri ve ülkemizde enerji mevzuatında yapılan reformlar ile piyasa yapısına geçiş süreci anlatılmıştır. Çalışmamızın esas bölümünü oluşturan ikinci bölümünde ise, Türkiye'de elektrik piyasa yapısına geçiş süreci, bu süreçte yapılan regülasyonlar ve elektrik hizmetlerinin kamu hizmeti nitelikleri üzerine değerlendirmelerde bulunulmuştur. Elektrik piyasası dönemi ile birlikte özel sektörün de kamu hizmetlerinin görülmesine dahil olması, bu nedenle denetimi sağlayacak bir üst kurul gerekliliği ve EPDK'nın doğuşu, elektrik hizmetlerinin lisans usulüne tabi tutulması ise bu bölümde ele alınacak başlıca hususlardır. Electric Energy has become one of the most essential tool to be used in daily life. In agriculture, transportation and business life, the electric energy is widely used. In addition to the fact that it is one of the cornerstones in economic and social life, it is also of a vital importance for the ultimate marginal consumer. Energy, is the essence of technology and is a nonesuch phenomenon for daily living. Energy establishes a unique and irreplaceable place in modern life. It is one of the most significant elements of the national economy. In the first part of our study, it is explained the definition of electric, its legal scope, the historical process from the date it was found, types of electric services, reforms that has been regulated in our country and transition process to the market structure. In the second and core of our study, assessments and evaluation were made on the transition process of Turkey into electric market structure, the regulations that were made in this time period and public service scope of the electric services. Incorporation of private sector into the execution of public services in the electric market period, need of a supreme institution on checks and balances, birth of the EPDK and application of electric service on license method are the main components are to be approached in this part of the study.
