AKREDİTİF İLE ÖDEME ŞEKLİNDE TEMİZ TAŞIMA BELGESİ

Abstract

Uluslararası ticarette güvenilir bir ödeme şekli olması nedeniylekendisine sıkça başvurulan akreditif aracılığıyla ödeme elde etmek içinbankaya ibraz edilen belgelerden biri olan taşıma belgesi hakkında kul-lanılan “temiz taşıma belgesi” kavramını tanımlamak ve ona uluslararasıalanda yer kazandırmak için ICC tarafından yayınlanan UCP aracılığıylaönemli adımlar atılmıştır. “Temiz taşıma belgesi” tanımına ulaşmayaçalışılırken ise taşıma belgesinin “temiz” olma vasfını elinden alan veyaalmayan çekinceler arasındaki farkı ortaya koymanın kolay olmadığıgörülmüştür. Ancak akreditif ile ödeme şeklinde banka yalnızca temiztaşıma belgesi kabul ettiğinden ve ödeme yapması, temiz taşıma belgesi-nin kendisine ibraz edilmesine bağlı olduğundan bu farkın tespit edilme-si önemlidir. En son yayınlanan UCP 600’e göre, temiz taşıma belgesi,eşya veya ambalajının ayıplı durumunu açıkça ifade eden bir kloz veyakayıt taşımayan belge olarak tanımlanmıştır.

One of the documents presented to the bank in order to get pay- ment by letter of credit, which is often used as a reliable method of pay- ment in international trade, is the transport document. ICC has taken important steps with the UCP to define the concept of "clean transport document" and to provide it’s internationally recognition. While trying to define “clean transport document”, it has been noticed that it is not easy to draw the distinction between the clauses which gives to the transport document it’s “clean” character or not. However, according to letter of credit as a method of payment, since the bank only accepts clean transport document and pays in return of it, it is important to iden- tify this. With respect to the published UCP 600, a clean transport do- cument is defined as one bearing no clause or notation expressly decla- ring a defective condition of the goods or their packaging.
