Trade Union Membership Assurance in the Constitution and International Contracts

Abstract

Trade union membership has been the subject of many regulations both nationally and internationally. Trade union membership which gained a constitutional guarantee for the first time with the 1961 Constitution, has also gained an international guarantee with many conventions prepared in the international arena. In our study, as well as membership guarantees which arranged in our Constitutions and International Agreements, Collective Bargaining Law No. 6356 and the Law on Public Servants Unions and Collective Bargaining No. 4688 have also been examined due to important guarantees regulations. Within the scope of the Law No. 6356, the union membership of the workers working with typical employment contracts, as well as the increasing atypical working relations in the working life all over the world, were examined in detail and the trade union membership of the workers working with atypical employment contracts and the attitudes of some countries on this issue were explained.Sendika üyeliği hem ulusal alanda hem de uluslararası alanda birçok düzenlemeye konu olmuştur. İlk kez 1961 Anayasası ile Anayasal bir güvenceye kavuşan sendika üyeliği, uluslararası alanda hazırlanan birçok sözleşme ile de uluslararası bir güvenceye sahip olmuştur. Çalışmamızda Anayasalarımızda ve Uluslararası Sözleşmelerde düzenlenen üyelik güvenceleri ile birlikte önemli güvenceler düzenlemeleri açısından, 6356 sayılı Sendikalar ve Toplu İş Sözleşmesi Kanunu ile 4688 sayılı Kamu Görevlileri Sendikaları ve Toplu Sözleşme Kanunu da incelenmiştir. 6356 sayılı Kanun kapsamında tipik iş sözleşmeleri ile çalışan işçilerin sendika üyeliği yanında tüm dünyada çalışma hayatında giderek artan atipik çalışma ilişkileri detaylı bir şekilde incelenerek atipik iş sözleşmeleri ile çalışan işçilerin sendika üyeliği ve bu konuda bazı ülkelerin tutumları açıklanmıştır.
