Kişi özgürlüğü ve güvenliği hakkı / Freedom of person and right of security

Abstract

Kişi özgürlüğü ve güvenliği hakkı, temel hak ve özgürlüklerin korunması açısından son derece önem taşıyan bir haktır. Bu hakkın özünü oluşturan özgürlük ve güvenlik kavramları birbirlerini tamamlayan nitelik taşımaktadır. Dolayısıyla kişi özgürlüğüne yapılacak insanlık onuru ile bağdaşmayan işkence ve eziyet tarzında hukuka aykırı eylem ya da işlemler, kişi güvenliğini de tehdit ederek insanların hukuk güvenliği içinde yaşamadığı bir yönetim modelinin oluşumuna yol açacaktır. Bu durum da hukuk devleti ilkesinin uygulamada işlerliğini yitirmesine neden olacaktır. Bu çalışmada; ilk bölümde öncelikli olarak kişi özgürlüğü ve güvenliği kavramlarının tanımına, dünyadaki tarihsel gelişimine ve uluslararası belgelere yer verilmiştir. İkinci bölümde ise Türkiye'de kişi özgürlüğü ve güvenliği hakkı başlığı altında Cumhuriyet öncesi dönemdeki tarihsel süreç ele alınmıştır. Daha sonraki aşamada ise bu hakka yönelik olarak getirilen güvence ve sınırlamalar AİHS ve AİHM içtihatları ile kıyas edilerek son hukuksal düzenlemeler ışığında incelenmiştir. Bunun akabinde sonuç bölümündeki görüşlerimizin sunumu ile çalışma tamamlanmıştır. ANAHTAR KELİMELER: Özgürlük, güvenlik, Anayasa, hukuk devleti ve hak. The right to individual freedom and security is of vital significance with regard to the protection of the fundamental rights and freedoms. The concepts of freedom and security, which constitute the essence of this right, are complementary to each other. Thus, any unlawful acts or treatments against the individual freedom, such as torture and torment, which violate the human dignity, will also threaten the individual security and pave the way for establishment of a regime where people do not live in legal security. This circumstance will cause the fact that the principle of the state of law loses its functionality in practice. In this study; firstly, the concept of individual freedom and security is defined and then, its historical development in the world and the relevant international documents are dwelt upon in the Chapter One. Furthermore, in the Chapter Two, the historical process in the period prior to the Republic is dwelt upon under the heading, the right to individual freedom and security in Turkey. After then, the guarantees and restrictions introduced for this right are analyzed by comparison with the European Convention on Human Rights and the jurisprudences of the European Court of Human Rights, in the light of the recent legislative arrangements Then, the study is completed with the presentation of our opinions in the Conclusion Chapter.
