Liman hizmetleri sözleşmesi ve liman işletenin sorumluluğu

Abstract

Liman işletenler, liman hizmetleri sözleşmesi ile iş sahiplerine liman hizmetlerini sunmaktadırlar. Liman hizmetleri sözleşmesi, liman işleten ile iş sahibi arasındaki ilişkileri düzenleyen ve liman hizmetlerinin sağlanmasına dair şartları belirleyen önemli bir sözleşmedir. Bu sözleşme, denizcilik sektöründe şeffaf ve düzenli bir işleyişin teminatını oluşturarak liman operasyonlarını etkin bir şekilde yönetmeyi amaçlar. Denizyolu ile eşya taşımacılığında taşıma konusu eşyanın zıyaa veya hasara uğramasının sıklıkla, liman işleten tarafından taşıma öncesi ve sonrasında ifa edilen yükleme, boşaltma veya depolama hizmetlerinin ve bunlarla bağlantılı işlemlerin yerine getirilmesi sırasında olduğu gözlenmiştir. Bu nedenle çalışmanın konusu eşyaya ilişkin liman hizmetleri ve buna bağlı liman içinde sunulan hizmetleri kapsamaktadır. Bu doğrultuda, çalışmanın kapsamında liman işletenin sunduğu yükleme ve boşaltma hizmetleri, depolama hizmetleri ve kılavuzluk ve römorkaj hizmetleri incelenmiştir. Liman hizmetleri sözleşmesinin ihlali halinde liman işletenin sorumluluğunun nasıl belirleneceği hususu liman hizmetleri sözleşmesinin içerisinde birden çok farklı sözleşme türünün karakteristik unsurlarını barındırması sebebiyle açıklanması gerekmektedir. Çalışmada bu çerçevede liman hizmetlerinin hukuki niteliği ve liman işletenlerinin sorumluluğu değerlendirilmektedir. Böylece, çalışma kapsamında liman hizmetleri sözleşmesinin ihlali neticesinde ortaya çıkan liman işletenlerinin sorumluluğu ile birlikte liman işletenin sözleşme dışı sorumluluğuna dair belirsizlikler giderilmeye çalışılmıştır.

Port operators provide port services to the contracting party through a port services agreement. The port services agreement is an important contract that regulates the relations between the port operator and the contracting party and determines the conditions for the provision of port services. This contract aims to manage port operations effectively by creating a guarantee of a transparent and orderly functioning in the maritime sector. It has been observed that the loss or damage to the goods subject to carriage in the carriage of goods by sea is frequently observed during the performance of loading, unloading or storage services and related operations performed by the port operator before and after the carriage. Therefore, the subject of the study covers the port services related to the goods and the related services provided within the port. Accordingly, loading and unloading services, storage services and pilotage and towage services provided by the port operator are analyzed within the scope of the study. Determining the liability of the port operator in the event of a breach of the port services agreement is a complex issue, as the contract incorporates elements of multiple contract types. In this framework, the study evaluates the legal nature of port services and the liability of port operators. Thus, within the scope of the study, the uncertainties regarding the liability of port operators arising as a result of the breach of the port services contract and the extra-contractual liability of the port operator are tried to be eliminated.
