Abstract
Ülkemizde 1985 yılında kabul edilen Köy Koruculuğu sistemi, güncel adıyla,Güvenlik Koruculuğu, hala çeşitli illerde uygulanmaya devam etmektedir. Günümüzde Güvenlik Koruculuğu sisteminde, “güvenlik korucuları” ve “gönüllü güvenlik korucuları”, köy ya da mahalle sınırları içerisinde güvenliği sağlamak üzeregörev yapmaktadır. Çalışmamızda, ilk olarak Türk Hukuku kapsamında güvenlikkorucularının görevleri ve özlük hakları açıklanmaktadır. Daha sonra, güvenlikkorucularına yönelik sosyal koruma üzerinde durulmaktadır. Bu kapsamda, öncelikle tazminat ve sigorta hakları incelenmekte, daha sonra korucuların aile fertlerineyönelik sosyal koruma hususu ele alınmaktadır. Son olarak, güvenlik korucularınınhukuki statüsüne ilişkin çeşitli yargı kararları değerlendirmemize konu olmaktadır.
The Village Guard System, which was adopted in our country in 1985, is still being implemented in various provinces, with its current name as the Security Guard System. In today’s Security Guard System, “security guards” and “volunteer security guards” serve to ensure the safety within the borders of the village or the neighborhood. In our study, first, within the scope of Turkish law, the duties and the personal rights of the security guards have been explained. Then, social protection for the security guards has been focused on. In this context, first the right to compensation and insurance rights have been elaborated, afterwards the issue of social protection for the family members of the guards has been explained. Consequently, various judicial decisions regarding the legal status of the security guards have been subjected to our assesment.
