Abstract
Çalışmamız iki ana eksende şekillenmiştir: İlk olarak Av- rupa İnsan Hakları Mahkemesi’nin ifade özgürlüğü yönünden mi- henk taşı niteliğinde olan Perinçek Kararı sonrasında uluslararası insan hakları hukukunda ifade özgürlüğü ve soykırım inkârı yasala- rı arasındaki dengenin nasıl sağlandığı incelenmiştir. Bu inceleme özellikle Bosna-Hersek ve Ruanda’da yürürlüğe giren inkâr yasaları ve ilgili yargı kararlarına dayandırılmış ve ulusal uluslararası mah- keme kararları ışığında ele alınmıştır. Bu bağlamda AİHM’in ortaya koyduğu “maddi olgu-değer yargısı” ayrımının doğurduğu dikoto- minin soykırımı inkâr eder nitelikte olduğu iddia edilen söylemlerin kategorizasyonunda ne ölçüde yeterli olduğu analiz edilmiştir. İkinci olarak ayrımcı ve nefret içerikli söylemlerin hâlihazırda nefret suçla- rı kategorisi altında cezalandırılabildiği dikkate alındığında soykırım inkârının ayrı bir suç kategorisi olarak düzenlenmesinin gerekliliği sorgulanmıştır. Sonuç itibarıyla nefret içermeyen soykırım teşkil et- tiği iddia edilen tarihi olaylar ile ilgili yapılan hukuki analiz niteliğinde- ki söylemlerin ifade özgürlüğü kapsamında korunması gerektiği ve bu tür söylemler için ayrı bir suç tipi oluşturulmasına gerek olmadığı tezi savunulacaktır.
