Abstract

Roma hukuku, İngiltere’de, Kıta Avrupası ülkelerinde olduğu gibi iktibasedilmese de, Gelenek hukukunun, Roma hukukundan etkilendiği çok açıktır. Gelenekhukukunda var olan çeşitli kavramlar, ilkeler, terminoloji, yargılama hukukunda geçerliolan çeşitli düzenlemeler, Roma hukuku kaynaklıdır. Her ne kadar aksini savunan bazıhukukçular bulunsa da, gelişimi halen devam eden Anglo-Amerikan hukukunun, gelişimi, medeniyetin gelişimi ile paralellik gösteren Roma hukukundan yararlandığı rahatlıkla söylenebilir.
Even though, Roman law was not excerpted in England to the extent that it was received on the Continent, it is obvious that Roman law has influence on Common law. Some of the concepts, principles, terminology, the jurisprudential principles that exist in Common law have their roots in Roman law. Although there are some jurists that maintain the contrary, we can easily sat that, the Anglo-American law which still contiues to grow, drew benefit from the Roman law, whose own growth so closely parallels the growth of civilization.
