Abstract

Çalışmamızda ifade ve sorgunun fonksiyonu, ifade alınırken dikkat edilmesi gereken ilkeler, ifadesi alınanın ya da sorgulananın hakları ve yükümlülükleri, ifade ve sorgunun icrası, yasak ifade ve sorgu açıklanmaya çalışılmıştır. Şüpheli ve sanık, olay hakkında belki de doğrudan bilgiye sahip tek kişidir. Bu bakımdan, şüpheli ve sanık beyanı olayın aydınlatılması, maddi gerçeğin ortaya çıkarılması bakımından son derece önemlidir. İfade ve sorgu işlemleriyle, ifade veren veya sorguya çekilen savunma olanağına kavuşurken; ifade alan ve sorguyu yapan ifade ve sorgu konusu olan olayla ilgili olarak gerçeği bulma imkânına kavuşmaktadır. Bu bakımdan ifade ve sorgunun icrası ile yasak ifade ve sorgu yöntemleri ile delil değerlendirme yasakları geniş şekilde ele alınmıştır.

In our study, we want to explain these topics: Function of expression and examination, the principles that should be considered at the time of expression and examination, precarious and accused’srights and obligations, execution of the expression and examination, prohibitedmethods of expression and examination. Precariousoraccused is single person who has knowledge about the event. In this regard, precarious/accused’s statement is very important for illuminating the event. So we want to explain these topics with all details; execution of the expression and examination and prohibitedmethods of expression and examination.
