    Legal Liability for Unlawful Use of Personal Data within the Scope of Protection of Personality

    Personal data is any information relating to an identified or identifiable natural person. Any operation performed on personal data shall be unlawful if the processor is not authorized to perform such an operation. Due to the fact that personal data has spread into every aspect of our lives, personal data is frequently processed in daily life. It is important to determine the liability arising from the unlawful nature of the processing activity in question and the liability regime that will arise. The importance of personal data protection law, which is an interdisciplinary field, is increasing with the rapid technological development and progress in today's world. Many issues related to this field are handled by different branches of law and an attempt is made to establish a link between technological developments and law and to make sense of these innovations within the legal framework. In our study, the liability arising in case of unlawful processing of personal data will be discussed in terms of private law and tort liability.

    Türk Borçlar Kanunu’nun 584. maddesiyle kanun koyucu tarafın-dan daha önce hukuk sistemimizde bulunmayan bir hüküm getirilmiştir. Buna göre eşlerden birinin kefil olabilmesi kural olarak diğer eşin rıza-sına bağlanmıştır. Bir geçerlilik şekli olan eş rızası kefalet sözleşmesi-nin kurulmasından önce veya en geç sözleşmenin kurulması anında veri-lebilir.Kanun koyucu Türk Borçlar Kanunu’nun 603. maddesiyle hukuk sistemimize bir yeni hüküm daha getirmiştir. Kefaletin şekline kefil olma ehliyetine ve konumuz bağlamında eşin rızasına ilişkin hükümler gerçek kişilerce kişisel güvence verilmesine ilişkin olarak başka ad al-tında yapılan diğer sözleşmelere de uygulanır. Bu çalışmada Yargıtay İçtihatları Birleştirme Büyük Genel Kurulu’nun E. 2017/4 K. 2018/5 ve 20.04.2018 tarihli kararından yola çıkarak aval müessesesinde TBK m.603 vasıtasıyla TBK m.584’ün uygulanmasının mümkün olup olma-dığını incelenecektir.

    İş Hukukunda Hafta Tatili

    İş hukukuna hâkim olan ilkelerden biri olan işçilerin korunması ilkesinin pek çok görünüm biçimi bulunur. Bunlardanbiri hafta tatili müessesesidir. Hafta tatilinin temel amaç ve işlevi işçilerin fiziken dinlendirilmesi olsa da işçininsosyal kültürel ailevi dini ve ekonomik hayatı bakımından önemli etkileri bulunur. İşçinin hafta tatiline hangikoşullarda hak kazanacağı hususu çalışmamızda gerek İş Kanunu gerekse diğer mevzuat hükümleri doğrultusunda incelenmiştir. Hafta tatilinde işçinin dinlenme hakkı ve hafta tatili ücretinin açıklanıp bu hakkın işçiye kullandırılmayıp hafta tatilinde çalıştırılması durumunda hangi hukuki sonuçların ortaya çıkacağının belirlenmesi gerekir. Budoğrultuda çalışmamızda konu hem ulusal hem de uluslararası mevzuat ışığında Yargıtay uygulaması da dikkatealınarak incelenmiştir.
